The woman accusing a University of Idaho football player of raping her told him “no” multiple times before being assaulted, according to court documents.

Kyree Curington was arrested Saturday in connection with a possible on-campus rape. His warrant was issued after he refused to meet with police during a previous phone call.

According to charging documents, police first received a report about the incident from the woman’s mother around 5 a.m. Dec. 7, who said her daughter had possibly been sexually assaulted.

When the woman first met with police, she confirmed she had attended Stubblefields Bar in Pullman with friends the night of the possible assault. She said she also tried marijuana for the first time that night.

The woman told police she and Curington had communicated through Snapchat and had a mutual agreement for them to sleep in her dorm bed.

At one point, Curington began grabbing at her. According to the documents, the woman refused the contact. He later licked her neck as the woman attempted to move away to get him to stop.

At one point, Curington was on top of the women and was “smothering her face with his face, so she could not make a sound.” She said he was “heavy on top of her,” according to the documents.

Curington eventually pulled both of their shorts down and quickly put on a condom before raping her, according to the documents.  The women said she was fighting Curington as it happened, trying to push Curington hard enough as to wake her roommate on the bunk below, who was listening to music through headphones at the time.

Curington left afterwards, saying his roommate was locked out of his room and needed to be let in. Police retrieved a condom wrapper from the women’s room.

After he left, the woman told police she called several friends and her parents, who told her to go to Gritman Medical Center, the documents show.

The woman’s roommate confirmed to police she heard pleas of “No, I don’t do that,” and “I thought we were just going to sleep” from the woman, according to the charging documents.

Video footage police obtained from security cameras corroborated the woman’s account that Curington entered her room in the Wallace Residence Center at around 3:35 a.m  Dec. 7. In the footage, she was seen walking with a male wearing the same outfit, except for his beanie, police say Curington wore when they interviewed him that morning. Video also showed him leaving the main floor of the dormitory hall around 4:15 a.m.

Curington initially told police that he did not know the woman, and he denied several times having gone into her room.

Curington later told police through a friend he would prefer to talk over the phone instead of in person, as he believed he was going to be arrested, the documents show.

Over the phone, Curington told police he would not take any action until his mother was in Moscow, saying he did not trust anyone, the documents show. He also refused to meet in person with police, the documents show.

Curington’s $75,000 was posted Sunday. He was arraigned in court Monday morning. Curington’s preliminary hearing is set for 10:30 a.m. Jan. 10.
