Judge denies Kohberger’s second motion to pause all court proceedings.

The Judge’s decision from August has been formally released in a written order.

Judge John Judge, presiding over the Kohberger case, has denied a motion filed by Bryan Kohberger’s defense to pause all proceedings in the trial. 

Judge’s order on this motion was stated orally on Aug. 18 in a hearing. The recent written order is the formal announcement of his decision from Aug. 18. 

The motion was filed by the defense on June 13. On July 7, the court issued an Order Staying Time for Speedy trial. In the order, the court denied Kohberger’s motion to stay all proceedings because the motion was premature according to court documents. 

The court ran the speedy trial clock for 37 days to allow the defense to review the grand jury records and determine if they wanted to renew their motion to pause proceedings. 

On July 17, the prosecution filed a motion to reconsider the order to Stay Time for Speedy Trial. 

On July 25, the defense would file a second motion to stay proceedings, due to irregularities with the Grand Jury that indicted Kohberger in May. On Aug. 11, the prosecution would file an objection to the defense’s motion.  

On Aug. 18, oral arguments on both the prosecution’s motion to reconsider, and the defense’s motion to stay proceedings were heard by the court. Kohberger’s second motion to stay proceedings was denied by the court. The prosecution’s motion to reconsider was granted.  

Six days later, on Aug. 23, Kohberger would waive his right to a speedy trial causing his trial to be suspended indefinitely. 

Kohberger’s next court appearance will be Oct. 26 in a hearing on arguments to dismiss the grand jury indictment.
